I GENERAL PROVISIONS

The general terms of Unlimited Properties & Solutions agency, in accordance with Article 28 of the Law on Brokerage Activities and Real Estate Leasing, define the business relationship between the real estate broker and the principal (legal or natural person).
Brokerage is carried out based on a brokerage agreement in the field of trade or real estate leasing concluded between the principal and the broker. By signing the brokerage agreement, the principal confirms that they accept, are familiar with, and agree to the provisions of the agency's general terms of business, with the signing to be completed before presenting a specific real estate property.
The seller/landlord or buyer/tenant, as the principal, is obliged to pay the brokerage fee to the broker upon the completion of the work.

II Description of the Agency's Work and Obligations

  • to enter into a written brokerage agreement with the client;
  • to attempt to find and bring a person into contact with the principal for the purpose of concluding a legal transaction;
  • to provide the principal with an objective opinion on the property price or rental amount for the property in accordance with its characteristics, market conditions, and other relevant circumstances;
  • to verify documents confirming ownership or other real rights on the property subject to brokerage for sale or lease;
  • to take necessary actions to present the property on the market, place advertisements related to the sale or lease of the property in the appropriate manner, and perform all other actions agreed upon during the brokerage, beyond the usual presentation, for which it is entitled to special, pre-agreed expenses;
  • to arrange property viewings;
  • to safeguard the principal's personal data and maintain as a trade secret information about the property or business involved in the brokerage;
  • to inform the principal of all circumstances known to them that are relevant to the transaction in question;
  • to mediate negotiations and strive to conclude an agreement;
  • to be present at the signing of a legal transaction (preliminary agreement);
  • to be present at the handover of the property;
  • to provide, at their own expense, professional legal assistance related to the drafting of agreements and other necessary documentation;
  • to maintain records of mediation and sub-mediation;

III Obligations of the Principal

  • to inform the broker of all circumstances relevant to the transaction;
  • to provide the broker with original documents proving their rights to the property subject to the transaction and to notify the broker of all registered and unregistered encumbrances on the property;
  • to enable the broker and the person interested in concluding a legal transaction to view the property in an agreed manner and at an agreed time;
  • to provide the broker with all relevant information about the property, including accurate details about the price, location, structure, etc.;
  • to pay the broker the agreed brokerage fee upon the completion of the transaction, and if separately agreed, to reimburse the broker for other expenses incurred during the brokerage;
  • to inform the broker in writing of any changes related to the brokerage work, especially changes regarding property rights, terms, and price, all within three days of the change;
  • to promptly notify the broker if a person who viewed the property through the broker (or a related person) expresses interest in concluding a contract/preliminary agreement for the purchase or lease of the property, or if any other legal transaction resulting from the broker's work is completed without the broker's involvement.

Prices are expressed in euros and are charged in the dinar equivalent at the average exchange rate of the NBS.
